Everyone who posts a card in the Hire Hub — mates, captains for hire, and photographers — agrees to the terms below before the card is submitted. Checking the box and typing your name in the card form is your electronic signature; your name and the submission time are recorded on the card.
What the Hire Hub Is. The Hire Hub is a listing and introduction service. It lets captains, mates, photographers, and other coastal workers post a public card describing their services so boat owners, captains, and customers can find them. FishTourHub is a marketplace and advertising platform only. FishTourHub is not an employer, staffing agency, booking agent, crew broker, payroll service, or payer for any hire made through the Hire Hub.
Eligibility and Accurate Information. I am at least eighteen (18) years old and legally authorized to work in the United States. I certify that every detail on my card — my name, experience, credentials, licenses, day rate, availability, location, contact information, and photos — is true, current, complete, and my own. I will update my card when anything changes. False, misleading, or stale information is grounds for removal.
My Credentials, Verification Consent, and Notification Duties. I hold, and will maintain for as long as my card is live, every license, credential, certification, insurance policy, permit, and health or food-safety authorization required by law for the work I advertise, and I will provide proof on request. I consent to FishTourHub verifying my credentials with the issuing agency, consortium, or insurer, and to contacting the references I list. I will notify FishTourHub within three (3) days if any credential or policy is suspended, revoked, restricted, or has lapsed, or if I am charged with an offense involving drugs, alcohol, violence, or dishonesty. FishTourHub does not verify, guarantee, or warrant any credential, skill, insurance, or background of any person listed, and its review or approval of a card is not an endorsement, certification, or background check.
Verification Is Not a Warranty. Any admin approval, "verified" badge, or credential review by FishTourHub is an administrative screening step only. It does not mean FishTourHub has confirmed my fitness, competence, safety, insurance, or legal compliance, and it does not shift any responsibility or liability from me to FishTourHub.
Independent Contractor. I am an independent contractor. Nothing in this Agreement creates an employment, agency, partnership, joint venture, or franchise relationship with FishTourHub. I am solely responsible for my own taxes, withholdings, insurance, business expenses, tools, transportation, and compliance with all federal, state, and local laws, including tax and labor law. FishTourHub does not withhold taxes and will not issue me a W-2.
No Guarantee of Work or Income. FishTourHub does not promise, guarantee, or project any number of inquiries, hires, trips, jobs, bookings, or income. Being listed does not mean I will be contacted or hired. I am not entitled to any minimum pay, shift, or placement, and FishTourHub may decline, hide, suspend, or remove any card at any time at its sole discretion.
The Deal Is Between Me and the Other Party. Any hire, trip, shoot, job, negotiation, rate, schedule, payment, gratuity, cancellation, dispute, injury, or loss arising from a Hire Hub introduction is solely between me and the boat owner, captain, customer, or business that hired me. FishTourHub is not a party to that arrangement, does not set or collect my rate, does not collect or remit my pay, and is not responsible for payment, non-payment, cancellation, no-shows, conduct, damage, injury, or any other outcome.
Safety, Insurance, and Assumption of Risk. I understand that work on the water and along the coast involves inherent risk, including weather, sea conditions, equipment failure, injury, and death, and I knowingly and voluntarily accept those risks. I will follow the safety instructions of the vessel or business that hires me and will not perform work I am not trained, licensed, or fit to perform. I carry my own medical, injury, and disability coverage and my own liability insurance where the work requires it. FishTourHub provides me no workers' compensation, health, disability, or liability coverage, and any policy a boat or business carries is between that operator and its insurer.
My Content, Name, and Likeness. I own the photos and text I upload. By posting them I grant FishTourHub LLC a worldwide, royalty-free, non-exclusive, sublicensable license to host, store, display, reproduce, crop, and use them in the app, on our website, and in our marketing and partner materials, without further compensation, and that license survives the end of my listing for material already published. I also allow FishTourHub to use my name, public photo, and likeness to promote the Hire Hub and the platform. I confirm I have the right to post every photo and that it does not infringe anyone else's copyright, trademark, or privacy. As a photographer, I confirm I hold the releases, permissions, and ownership rights needed for every image I advertise or deliver.
Platform Content and No Copying. FishTourHub owns its name, logo, hub names, design, code, and platform content. I will not copy, scrape, republish, or resell FishTourHub listings, customer data, or content, and I will not use the FishTourHub marks to imply endorsement of my business beyond my listed card.
No Circumvention of Platform Rules. I will not use the Hire Hub to post false cards, impersonate anyone, advertise work I cannot legally perform, spam other users, or route platform data to a competing marketplace. I will not ask a boat owner, captain, or customer I met through FishTourHub to move a booking or an ongoing engagement off-platform to avoid any FishTourHub fee, and this restriction continues for twelve (12) months after my card is removed for anyone I met through FishTourHub.
Fees — Current and Future. Posting a Hire Hub card is currently free. FishTourHub may in the future charge for a card, for premium or featured placement, for a subscription, for verification, or for other Hire Hub features, and may change those fees. Any fee will be disclosed in the app or on this page before it is charged, and I will only be billed after I accept it. Fees already paid are non-refundable except where the law requires otherwise. If I do not pay a fee when due, FishTourHub may hide or remove my card until it is paid. If this Agreement or a Hire Hub fee changes, continued use of the Hire Hub after the change is posted, or a new payment I make, is acceptance of that change.
Conduct and Removal. FishTourHub may suspend, hide, or remove my card, and may refuse future submissions, if I misrepresent myself, fail to keep credentials current, behave abusively or unlawfully, generate customer complaints, or engage in conduct FishTourHub reasonably considers harmful to the marketplace or its users. Removal for cause does not entitle me to a refund of any fee.
Release of Claims. To the fullest extent permitted by law, I release and waive any claim against FishTourHub LLC and its owners, officers, members, and staff for injury, illness, death, property damage, lost income, or other loss arising out of or relating to any hire, trip, shoot, job, or introduction made through the Hire Hub, or the operations of any boat or business I work with, except to the extent caused by FishTourHub's own gross negligence or willful misconduct.
Indemnification. I agree to indemnify, defend, and hold harmless FishTourHub LLC, its affiliates, officers, members, agents, and partners from any claim, demand, loss, damage, liability, cost, or expense (including reasonable attorneys' fees) arising out of my card, my services, my conduct, my content, my violation of this Agreement, or my violation of any law or third-party right, including any claim by a boat operator, customer, or insurer relating to my work, and any claim that I was misclassified or am owed employment taxes, benefits, or workers' compensation in connection with work I advertised or obtained here.
Liability Limits. To the fullest extent permitted by law, FishTourHub LLC is not liable for any indirect, incidental, consequential, special, or punitive damages, and its total liability to me for any claim arising out of the Hire Hub will not exceed one hundred dollars ($100) or the amount I paid FishTourHub in the twelve months before the claim, whichever is greater. FishTourHub provides the Hire Hub "as is" without warranties of any kind.
Cooperation. I will cooperate with FishTourHub, the boat or business that hired me, the U.S. Coast Guard, and any insurer in the investigation of an incident, injury, complaint, or claim relating to a hire made through the Hire Hub, including providing a written statement and any records I hold.
Term and Termination. This Agreement continues while my card is listed and may be ended by me by removing my card, or by FishTourHub at any time. Sections 9, 11, 14, 15, 17, 20, and 21 survive the end of this Agreement.
Changes to This Agreement. FishTourHub may update this Agreement with notice in the app or by email. Where the app asks me to accept a new version, my acceptance, or my continued use after the update is posted, is acceptance of that change.
Dispute Resolution; Class Action Waiver. Any dispute arising out of this Agreement or the Hire Hub will be resolved by binding individual arbitration in Virginia Beach, Virginia, under the rules of the American Arbitration Association, governed by the laws of the Commonwealth of Virginia. Either party may bring an individual claim in small claims court, and FishTourHub may go to court to protect its intellectual property or confidential information. I waive any right to a jury trial, and any right to participate in a class, collective, or representative action.
Electronic Signature and Notices. I agree to receive this Agreement and related notices electronically, and that a typed name, my account email, and a submission timestamp are a valid signature under the federal E-SIGN Act and Virginia's UETA. Notices to me go to the email on my account.
By checking the box and typing my name, I acknowledge that I have read, understood, and agree to this Hire Hub Agreement, including the assumption of risk, release, and indemnity in Sections 8, 14, and 15, and that my typed name, account email, and the timestamp of submission constitute my electronic signature.
